Hamilton permits: decks, sheds, fences and pools

When you need a building permit, how to apply and book inspections, and the property by-laws.

In Hamilton a building permit is needed for most construction, including additions, basement finishing, attached decks and sheds over 15 square metres, and permits are applied for and paid online through the City's Customer Portal at my.hamilton.ca. Fences need no permit unless they enclose a pool, but the Fence By-law limits their height. By-law complaints go to Municipal Law Enforcement at 905-546-2782.

Do I need a building permit?

What work needs a building permit in Hamilton?

Most construction does. The City's list includes additions (including enclosing a porch), finishing a basement or other space, adding or removing walls, new or enlarged door and window openings, structural repairs, underpinning, replacing roofing or cladding with a different material, waterproofing foundation walls, new or relocated plumbing, wood stoves and fireplaces, solar panels, new guards or railings, and additional dwelling units.

A permit is only issued if the project complies with the Zoning By-law, and other approvals may be needed first, for example from a conservation authority or the Niagara Escarpment Commission.

What work does not need a building permit?

No permit is needed for a fence that does not enclose a pool, minor millwork, cabinetry and flooring, painting or decorating, re-shingling with the same roofing material, replacing plumbing fixtures in the same location, replacing windows with the same size in the same location where no fire rating is required, replacing a furnace, or landscaping.

Landscaping that changes grading may need a Site Alteration Permit.

Do I need a permit for a shed or detached garage?

Not if it is accessory to a detached, semi-detached or row house and is not more than 15 square metres, not more than one storey and has no plumbing. A detached accessory structure such as a shed, garage, gazebo or carport over 15 square metres needs a permit, as does any detached structure with plumbing.

For other uses the exemption is 10 square metres without plumbing. Structures that need no permit must still meet the Zoning By-law.

Do I need a permit to build a deck or porch?

Yes for any deck or porch, covered or not, attached to a building; a detached uncovered deck over 10 square metres and more than 200 mm above grade; a detached covered deck over 10 square metres at any height; and a detached deck of 10 square metres or less next to a door and more than 600 mm above grade. A deck used with a swimming pool also needs a permit, as does replacing or installing guards (railings).

Decks and porches that need no permit must still meet the Zoning By-law.

What happens if I build without a permit?

Consequences can include an order to comply that may be registered on title, a ticket with a set fine, an order to stop work, legal action, extra costs to fix the work, and additional fees under the Building Permit By-law. Under section 36 of the Building Code Act the maximum fine for a first offence is $50,000 for an individual and $500,000 for a corporation.

Fences and pools

Do I need a permit to build a fence?

No, you do not need a building permit for a fence unless you are installing a swimming pool or replacing an existing pool enclosure. The fence must be on your own property, unless you and your neighbour agree to put it on the shared property line. Fences on residential and commercial properties cannot exceed 2 m (6 feet 6 inches), and are usually lower in front yards and on corner lots.

On a corner lot or for a front-yard fence, the City asks you to call Municipal Law Enforcement at 905-546-2782 first. Fence disputes between neighbours are a civil matter the City does not get involved in.

How high can a fence be near the street or driveway?

A fence may not exceed 0.9 m within a corner visibility triangle, a driveway visibility triangle, or 3.0 m of a front lot line. Elsewhere the general limit is 2.0 m (3.0 m in an industrial zone or on a farm). A gate may exceed the limit by up to 0.3 m, an archway by 0.4 m, and a decorative cap or post by 0.15 m. Sheet metal or corrugated metal fences are not allowed in residential zones.

A fence of up to 2.4 m is allowed if it is at least 1.2 m from a side lot line and 3.0 m from the rear lot line and no more than 4.5 m long.

Does my neighbour have to share the cost of a fence?

The cost of a 122 cm (4 foot) chain link fence must be split 50/50 between neighbours; any other cost sharing is for the owners to decide, and the City does not get involved. If your property abuts City park land, a district yard or a recreation area, the City pays half the cost of a 122 cm chain link fence.

Do I need a permit for a swimming pool?

You do not need a building permit to install the pool itself, but you do need one to build the pool enclosure (fence), and a separate permit for a deck built with or next to the pool. Every pool must have an enclosure meeting the Swimming Pool Enclosure By-law No. 16-184. Do not excavate or build the enclosure before you have the permit, and do not fill the pool until the enclosure is in place and the City has given final approval.

The enclosure must be at least 1.5 m high, at least 1.0 m from the inside pool wall, with no opening that passes a 100 mm sphere, and every gate must be self-closing and self-latching at the top on the inside. A completed Swimming Pool Enclosure Checklist goes with the application.

Applying, fees and inspections

How do I apply for a building permit?

Online, through the City's Customer Portal. Create a City of Hamilton account at my.hamilton.ca, select the Building Permits category to set up your Customer Portal account, then go to Getting Started and select Permitting & Inspections. The owner or an agent acting for the owner can apply. Drawings must be submitted as vector-based PDFs, drawn to scale.

You must give the licence number of the contractor doing the work; contractors such as roofers, carpenters, plumbers and HVAC contractors need a valid City trade licence.

How much does a building permit cost?

Fees are set by the Building Permit By-law 15-058 and must be paid in full, online, when you apply; an application is not accepted until payment is received. Most fees are a service index multiplied by the floor area of the work, rounded to the nearest dollar, with a minimum permit fee of $291.

How do I book a building inspection?

Call 905-546-2424 ext. 7777, Monday to Friday from 8:30 a.m. to 4:30 p.m., or email building@hamilton.ca; permits applied for online can book inspections through the Customer Portal. Have the permit number, address, preferred date and time, and type of inspection ready. Requests are completed within 2 business days. The permit must be posted on site and the approved drawings available.

Inspections at the required stages are mandatory; missing one may mean uncovering finished work. If the work is not ready and you do not cancel before the inspector arrives, you may be charged additional fees.

Property by-laws and complaints

How do I report a by-law problem?

Online through my.hamilton.ca under By-law, Parking and Provincial Offences, or by phone at 905-546-2782 from Monday to Friday, 8:30 a.m. to 4:30 p.m. Online complaints are monitored during business hours only. Staff will ask for your name and phone number (kept confidential), the address, and details including dates and times.

For an urgent health and safety issue, call instead: 905-546-2782 in business hours or 905-546-2489 (905-546-CITY) outside them. Parking complaints go to 905-540-6000 and animal complaints to 905-574-3433.

What do the yard and property standards by-laws require?

Under the Yard Maintenance By-law 10-118 you must keep your property clean of waste, keep grass and weeds no higher than 20 cm (8 inches), and keep buildings, fences, walls and vehicles free of graffiti. The Property Standards By-law 23-162 requires owners to maintain and repair the inside and outside of their property to set standards.

If you do not meet an Order to Comply under either by-law, the City can do the work and charge you a fee, which you can ask to have reviewed.
