Hamilton Council approves a 12-storey, 161-unit building at 520 Highway No. 8 and Dewitt Road in Stoney Creek
Council voted 9 to 6 on September 9 to redesignate and rezone the commercial corner at Highway No. 8 and Dewitt Road for a 12-storey apartment building. Conditions on sewer capacity, water pressure and escarpment views must be met before it can be built.
The details
The decision
Hamilton City Council approved applications for an Official Plan Amendment and a Zoning By-law Amendment for 520 Highway No. 8 in Stoney Creek (Ward 10) at its September 9, 2026, meeting. The item was voted on separately and carried 9 to 6, according to the Council minutes. Planning Committee had considered the applications at a public meeting on September 1.
The amendments redesignate the land from "Local Commercial" to "Medium Density Residential 3" in the Western Development Area Secondary Plan, with a site-specific policy permitting a 12-storey multiple dwelling of 161 units, and rezone it to the Mixed Use Medium Density (C5, 970, H220) Zone.
- Southwest corner of Highway No. 8 and Dewitt Road; about 0.32 hectares
- One-storey commercial building, to be demolished
- 12
- 453
- 106 vehicle spaces, mostly underground with a stacking system; 124 bicycle spaces
- From Dewitt Road; the Highway No. 8 driveway would close
- About 503 units per net hectare
What changed from the first proposal
The original proposal was for an 11-storey, 161-unit building. The revised version is 12 storeys with larger setbacks and stepbacks along the western lot line, where it borders homes. The unit count is unchanged, the height rises from 38.3 to 39.15 metres, and parking rises from 103 to 106 spaces. Staff said a sun shadow study showed neighbouring properties to the west and south would keep at least three hours of sunlight on the spring equinox.
Conditions before building
- An updated servicing report showing enough downstream sanitary sewer capacity, including confirmation that upgrades identified for Highway No. 8 are complete and any payments for downstream works on Dewitt Road are made.
- An approved watermain hydraulic analysis modelling system pressures.
- A revised visual impact assessment approved by the Niagara Escarpment Commission.
Staff also noted that privacy measures such as screening the roof garden and limiting windows on the west and south walls can be reviewed at the site plan stage.
Public consultation
The report says 53 residents attended an open house on March 12, 2026. A public meeting set for July 28 was cancelled, notice of the amended application went out on July 24, and notice of the September 1 meeting was circulated on August 21. The Council minutes list 14 numbered correspondence items received on the application.
