The details

What the committee approved

On September 28, 2026, Hamilton's General Issues Committee voted 9–0 to approve staff Report HSC26058, giving the City's consent, as Service Manager under the Housing Services Act, 2011, for Stoney Creek Community Homes Inc. to demolish 28 existing townhouse units at 34 Mistywood Drive in Stoney Creek (Ward 9) and redevelop that part of the social housing site with a six-storey, 128-unit mixed-income building.

Rent-geared-to-income units and tenants

The City funds rent-geared-to-income (RGI) subsidies for 41 units at 34 Mistywood Drive, 19 of them in the townhouse blocks proposed for demolition. When the new building is complete, those 19 subsidies would transfer to it, so that all 41 RGI units on the property are maintained. The report says the transfer does not create new subsidy commitments for the City.

Before any demolition, the housing provider must have a tenant relocation plan approved by the General Manager of Healthy and Safe Communities. The report says it must, at a minimum, give affected tenants the right of first return at the same rent level, at least $2,500 in compensation for moving expenses (more where tenants have special needs), applicable gap payments, a communication strategy, and an offer of a replacement unit with the same number of bedrooms and a comparable size.

Financing and approvals still needed

The consent is conditional on the relocation plan, on obtaining all approvals required under the Planning Act, the City's Rental Housing Protection By-law and the Zoning By-law, and on securing financing. The report says the provider intends to seek funding and financing through Canada Mortgage and Housing Corporation and Build Canada Homes as well as provincial and municipal sources, and that its pro forma assumes the City's affordable housing development charge exemptions. The consent states that it does not fetter Council's discretion on any Planning Act application for the site.

Stoney Creek Community Homes, a community housing provider founded in 1983, owns five properties in upper and lower Stoney Creek with 369 units, according to the report. It has applied under the Rental Housing Protection By-law and consulted current tenants, the report says.
